1. Binding Agreement

By registering for, bidding in, or purchasing from any auction conducted by Aeron House, LLC (“Aeron House, ” “we, ” “us”), you agree to be legally bound by these Terms.

These Terms apply across all platforms, including but not limited to LiveAuctioneers, HiBid, and BidSpirit.

2. Photos Govern All Bidding (Critical Term)

ALL BIDDING MUST BE BASED ON PHOTOGRAPHS ONLY.

• Titles, descriptions, and catalog text may be AI-generated or assisted and may contain errors, omissions, or inaccuracies
• Photographs take absolute precedence over all written content
• No description, title, or metadata constitutes a guarantee of authenticity, condition, or completeness

Authentication & Representation

• Any references to authentication (e.g., COA, serial numbers, third-party authentication) must be visually confirmed in the photographs
• If authentication is not clearly shown, it must not be assumed to be included
• It is the bidder’s sole responsibility to request clarification prior to bidding

No Assumptions Clause

• Variations in color, scale, or detail due to lighting or screen differences are not grounds for dispute
• Absence of reference objects means size must not be assumed

Failure to review photos does not invalidate a sale.

3. Buyer’s Premium, Fees, and Taxes

• A 22% Buyer’s Premium is added to all hammer prices
• Applicable sales tax will be collected unless exempt
• Processing fees may apply depending on platform/payment method
• All premiums and fees are non-refundable

4. As-Is, Where-Is; No Guarantees

All items are sold:

AS IS, WHERE IS, WITH ALL FAULTS

Aeron House makes no warranties, express or implied, including:

• Authenticity
• Attribution
• Condition or grading
• Functionality
• Merchantability or fitness for any purpose

The absence of a defect in description does not imply absence of defects.

5. Auction Conduct & Bidding Authority

Aeron House reserves the absolute right to:

• Reject or cancel any bid
• Advance or reopen bidding
• Resolve disputes at its sole discretion
• Withdraw or reoffer any lot

Off-Platform & Discretionary Bidding

Aeron House reserves the right to:

• Accept bids from any source, including phone, email, or in-person
• Enter such bids into the auction or apply them at its discretion
• Accept offers outside of the auction platform during the live or timed auction

Clerking & Finality

• All sales are subject to final clerking by Aeron House
• A bidder is not considered the winning bidder until:
• The auction has closed, AND
• The lot has been officially clerked and invoiced

Aeron House records are final and conclusive in all cases.

6. Platform Disclaimer

Bidding platforms act solely as intermediaries.

The transaction is strictly between the bidder and Aeron House.

Aeron House is not responsible for:

• Platform errors
• Bid delays or failures
• Synchronization issues between platforms

7. Registration & Bidder Responsibility

• Registration approval is at Aeron House’s sole discretion
• Identity verification may be required
• Bidders are responsible for all activity under their account

8. Payment Terms

General Payment

• Payment is due immediately upon invoice
• Items will not be released until payment clears

High-Value Payment Requirements

• Under $7,500: credit card may be used
• $7,500+: may require ACH or wire
• $15,000+: wire transfer required unless approved otherwise

Aeron House reserves the right to determine acceptable payment methods at its sole discretion.

9. Right to Refuse Payment Methods

Aeron House may refuse any payment method, including credit cards, for any transaction.

Failure to comply with required payment methods may result in:

• Cancellation of sale
• Revocation of bidding privileges
• Reporting to bidding platforms

10. Non-Payment & Enforcement

If payment is not received within 7 days:

• A non-payment dispute may be initiated
• Bidding privileges may be revoked

11. Chargebacks & Legal Enforcement

By bidding, you agree:

• Not to initiate chargebacks or payment disputes
• To contact Aeron House first for resolution

If a chargeback occurs, Aeron House reserves the right to:

• Recover full invoice amount
• Recover all fees, legal costs, and collection expenses
• Report bidder to all platforms

The bidder agrees to jurisdiction in Pennsylvania courts.

12. Shipping, Risk, and Insurance

• All shipping is handled in-house via Shipping Saint
• Shipping, handling, and insurance charges apply

Transfer of Risk

Title and risk of loss transfer to the buyer upon delivery to the carrier.

Insurance & Claims

• Shipments are insured through Shipping Saint
• The buyer is solely responsible for filing claims with the carrier
• Aeron House may assist, but is not responsible for claim outcomes

13. Handling Fees

A handling fee may be applied per order to cover:

• Labor
• Packing materials
• Processing and logistics

14. Pickup, Storage, and Forfeiture

• Items must be shipped or picked up within 20 days

After 20 days:

• Items are forfeited without refund
• Ownership reverts to Aeron House or consignor
• Aeron House may resell items without notice
• All resale proceeds are retained

15. Returns & Cancellations

• All sales are final
• Bids may not be cancelled or retracted

No returns for:

• Buyer’s remorse
• Condition disagreements
• Failure to review photos

Approved returns (rare):

• Subject to 20% restocking fee
• Must be in original condition

16. Clerical Errors

Aeron House reserves the right to cancel or void any sale resulting from:

• Clerical errors
• Catalog mistakes
• System or software issues

17. Prohibited Conduct

Bid rigging, collusion, or manipulation may result in:

• Immediate banning
• Platform reporting
• Legal action

18. Limitation of Liability

Aeron House is not liable for:

• Errors in listings
• Platform failures
• Shipping delays or damage
• Third-party actions

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

20. Final Acceptance

By bidding, you confirm that you:

• Have read and understood these Terms
• Accept all risks associated with bidding
• Agree to all payment, shipping, and forfeiture policies
• Agree to be legally bound by these Terms
