This Buyer Disclaimer outlines the terms and conditions under which buyers ("you" or "buyer") agree to use the Bidspirit platform for bidding on and purchasing items listed at auction.

By participating in an auction or purchasing items through Bank Hall Auctions via the Bidspirit platform, you agree to abide by the following terms and conditions:

1. Bidding and Auction Participation

By placing a bid on an item, you are committing to purchase the item if your bid is successful. You acknowledge that:

• Winning bids are legally binding and cannot be retracted once placed.

• You are solely responsible for ensuring that the bids you place are within your budget and your intended purchase range.

• You are aware that, once an auction ends, you may be required to purchase the item at the final bid price, which includes applicable taxes, shipping costs, and any other fees.

2. Accuracy of Auction Information

While Bank Hall Auctions aims to provide accurate and detailed information about auction items, you understand that:

• The descriptions, images, and details provided in each listing are for informational purposes only and may not be exhaustive.

• You are encouraged to ask questions and request additional information before placing a bid on any item.

• Bank Hall Auctions does not guarantee the accuracy, authenticity, or condition of the items listed for auction. Any issues with the condition or authenticity of the item should be resolved directly with the seller.

3. Payment Obligations

By winning an auction, you agree to:

• Pay the full amount of your winning bid, including applicable taxes, fees, and shipping costs.

• Provide accurate payment details to Bank Hall Auctions for processing the transaction.

• Complete the payment promptly upon the conclusion of the auction. Failure to do so may result in cancellation of the sale and the item being offered to another bidder or relisted for auction.

Bank Hall Auctions accepts payments through debit card, bank transfer, chip and pin and any payment processing fees will be disclosed during checkout.

4. Shipping and Delivery

You acknowledge that:

• After successfully purchasing an item, you are responsible for providing a valid and accurate shipping address.

• Sellers are responsible for shipping the item within the timeframe indicated on the auction listing. However, Bank Hall Auctions is not liable for shipping delays, damages, or lost items.

• You should review the shipping terms and options provided by the seller, and ensure that you are comfortable with the shipping method and costs prior to placing a bid.

Once an item is shipped, tracking information will be provided to you if available.

5. Buyer's Due Diligence

You agree to conduct your own research and due diligence on any items you are interested in purchasing, including:

• Asking the seller for additional details or photographs if necessary.

• Ensuring that the item meets your expectations for quality, condition, and authenticity.

• Understanding that Bank Hall Auctions is not responsible for any errors, omissions, or misrepresentations in the listings, and that disputes related to the quality or authenticity of items should be resolved with the seller.

6. Auction Fees and Taxes

You understand that:

• You may be responsible for additional fees, such as sales tax, buyer’s premiums, or processing fees, depending on the item, location, and auction terms.

• Taxes and fees will be disclosed during checkout, and you are expected to pay the full amount owed.

7. No Warranty or Guarantee

Bank Hall Auctions provides the Platform for the purposes of facilitating the auction process but makes no warranty or guarantee regarding the items listed. This includes, but is not limited to:

• No guarantees regarding the condition, authenticity, or legality of items sold.

• No warranty regarding the accuracy of the descriptions or images provided by sellers.

All items are sold "as is, " and it is the buyer’s responsibility to thoroughly review the listing and ask any questions before bidding.

8. Prohibited Conduct

By participating in an auction, you agree not to:

• Engage in fraudulent or dishonest activity, including but not limited to placing fake bids, bidding on items without the intent to purchase, or attempting to manipulate auction outcomes.

• Use the Platform to bid on items that are illegal or violate the Platform’s terms and conditions.

• Transfer or sell your auction account or bid rights to third parties without the permission of Bank Hall Auctions.

Any breach of these rules may result in the suspension or termination of your account and forfeiture of any items you have won.

9. Cancellation of Sale

In the event of non-payment or failure to honor a winning bid, Bank Hall Auctions reserves the right to cancel the sale and may take legal action to recover any damages.

If you are unable to pay for an item or need to cancel a transaction, you must notify Bank Hall Auctions immediately. We reserve the right to charge cancellation fees or take appropriate action against accounts with repeated non-payment issues.

10. Dispute Resolution

If you encounter a dispute with a seller regarding a purchase, you agree to:

• Attempt to resolve the matter directly with the seller.

• If a resolution cannot be reached, Bank Hall Auctions may, at its sole discretion, assist in mediating the dispute.

• In the event of a legal dispute, you agree to resolve the matter under the jurisdiction of the courts of the United Kingdom.

11. Amendments to the Disclaimer

Bank Hall Auctions reserves the right to modify, update, or amend this Buyer Disclaimer at any time. Any changes will be posted on the Platform, and the effective date will be updated accordingly.

12. Governing Law

This Disclaimer is governed by the laws of the United Kingdom. By using the Platform, you agree to comply with all applicable laws and regulations.
