לעשות בו סוכות בחג שווה בשווה - Psak Beit Din Signed Twice! by the Gaon Rabbi Shmuel Heller Av Beit Din of Safed - Safed, 1852 - Psak Beit Din on matters of Chatzer Hashutafin with a special reference to the festival of Sukkot, signed by Rabbi Shmuel Heller Av Beit Din of Safed and a disciple of the Chozeh of Lublin - with the signatures of the Dayanim Rabbi Yaakov Shapira and Rabbi Baruch Kahana - Safed, Tamuz, 1852.  The Psak Beit Din refers to dealings between Rabbi Shmuel Motel and Mrs. Ester Rivkah, who owned a shared yard (Chatzer) and a wall that seperated between their houses. The Psak Din describes at length the borders of the Meitzar and how the yard can be used by each of the partners. At the end of the letter, there is special reference to the festival of Sukkot, stating that the yard belongs to both parties and each has the right to build his/her Sukkah there and take it down after the holiday: ”לבאר כי החצר שייך לשני הצדדים בשוה לעשות בו סוכות בחג שוה בשוה ותיכף אחר החג מחויב כ”א לסתור סוכתו..” To this addition, Rabbeinu added his signature for a second time.  14.5X19.5 cm.  Dampness stains. Fair condition.  Enclosed are two ancient documents pertaining to the Psak Din:  1. Psak Beit Din pertaining to the same dispute between the neighbors, preceding the first document, signed by the Dayanim Rabbi Yaakov Shapira and Rabbi Baruch Kahana - Safed, Sivan, 1852. Stains. fair-good condition.  2. Copy of the first document which was apparently done in the late 19th century - signed by the witnesses who stated that it was true to the original, Rabbi Avraham Moshe ben Asher Anshil and Rabbi Yisrael ben Menachem of Warsaw.  Good condition.  The Gaon Rabbi Shmuel Heller (1803-1884), the Rav of Safed and a leader of the Ashkenazic community there for more than 40 years. He was the great-grandson of Rabbi Yom Tov Lipman Heller, author of the Tosfot Yom Tov. His grandfather, Rabbi Avraham Peretz was a Chassid of the Chozeh of Lublin, and took his grandson, Rabbi Shmuel, to him, meriting great Giluyim in his presence. Rabbeinu recalled that he received his Rav's blessing over a hundred times!!! Immigrated to Eretz Yisrael and settled in Safed, where he became close to the Admor Rabbi Avraham Dov of Avritch, the Bat Ayin, whom he succeeded as Rav after his passing. He was considered a proficient healer using the flora of the country. He succeeded in rehabilitating Safed after its destruction by an earthquake. His grandson was the Admor of Toldot Aharon Rabbi Avraham Yitzhak Kahan.
