Rare Bichel Some of which was Not Printed, with the Torah of the Admor the Tzemach Tzeddek and the Maharil of Yanovitz - Manuscript, Kuntres, 16 pages, on Hilchot Ne'emanut in Shechitah, copied from the response of teh Tzemach Tzeddek of Lubavitch in his lifetime - a large part of the response was not printed in his Shut - at the end of the Kuntres, a copying of a response by the Maharil author of the She;erit Yehuda on Hilchot Yom Kippur for a woman who just gave birth with a lengthy and interesting  passage on the practical Halacha, which was omitted from the printed version of the response and containing unknonw Piskei Halacha by the brother of Baal HaTanya about Shi'ur Achilat Pras and Kulot regarding Yom Kippur for a woman who gave birth more than seven days before Yom Kippur, with a description of the Baal HaTanya's pious and gentle granddaughters:  ”נשים צדקניות” מפונקות רכות וענוגות ”מביתו של רבינו ז”ל”.  - The lengthy responsum in this Kuntres was sent to the Gaon Rabbi Yehuda Leib Moreh Tzeddek of Bover.  - The shorter responsum was printed in Shut Tzemach Tzeddek, Yoreh Deah, Siman 246.  - The lengthy responsum that was edited to be printed, with all the reasoning, was printed there in Siman 3.  This is a Kuntres containing the lengthy responsum as it was sent to the Rav who asked the question, with all the details and names of rabbis and Shochatim that were involved, inclusing dates and places, much interesting information about some Shochatim and Bodkim, their knowledge, Yirat Shamayim, Ne'emanut etc. The Kuntres contains information about disputes and petty political issues in varied communities, which were naturally omitted from the printed version. In short, a most 'lively' Kuntres.  In addition, the format of the responsum varies from that of the printed version and thsi version seems longer and more detailed.  *** On the last page of the Kuntres, there is a copying of a response by the Maharil of Yanovitz author of the She'erit Yehuda, from Tishrei 1805. The copying was done by the famed Moreh Tzeddek Rabbi Yissachar Ber of Lubavitch .  The responsum was printed in Shut She'erut Yehuda (Brooklyn 2009 edition), Orach Chaim, Siman 15, pp. 142-145. However, in the printed version, a long passage was omitted about Kulot on Yom Kippur for a woman who gave birth eight days before Yom Kippur. Due its importance, following are several lines, most of which were omitted from the printed version: ”...בדבר אשתך שילדה בצ”ג [=בצום גדליה], ויו”כ הוא יום ח', ושואל אולי יש אצלי קבלה בזה מרבינו ז”ל להקל, דלפי פסק הש”ע [=השלחן ערוך] אסורה לאכול אפי' רביעי'... והנה ע”ד שיעור פ '[חות] מככותבת שיער רבינו אחמו”ר [אולי: אחי מורי ורבי] ז”ל... ושיעור השהיי' כמו ה' או ו' מינוטין (הוא כדא”פ [=כדי אכילת פרס] )... דרך כלל שמעתי מפי ק' של רבינו אמו”ר ז”ל נ”ע שצווני שלא להחמיר כ”כ בחולים בזה”ז שהם חלושי כח, ועפ”י הרוב יש להם מיחוש באברים הפנימי', ועכ”פ בפ'[חות] פחות מכשיעור ידעתי שהיה מקיל לכמה אנשי', והכל לפי הענין אם נ'[ראה] שהשעה צריכה לכך. וכך אני אומר (גם באשתך) שעם היות שהפוסקי' החמירו ביולדו' אחר ז' אפי' אמרה צריכה אני מחמת לידה... מאן מפיס האידנא לומר שצריכה מחמת לידה דוקא ולא מסבה אחרת, ובפרט במפונקי' הרכים והענוגי' כביתו של רבינו ז”ל בכללותם , וקרוב הדבר לבוא לידי סכנה ח”ו, ואפי' מחמת לידה גופא יכול להתהוות איזו סיבה שאינה כדרך היולדות דעלמא וד”ל. לזאת אין להחמיר כ”כ בפ'[חות] פחו'[ת] מכשיעור. ואף שידעתי נאמנה שבזה”ז רבו נשים צדקניות, ובפרט בביתו של רבינו ז”ל, שבודאי לא תאמר האשה בעצמה צריכה אני, מ”מ עליך לדקדק הרבה בכדי להקל להאכילה, ובפרט שיש בעירך רופא מומחה עליו תוכל לסמוך וככה תתנהג עם הרבנית תחי'... ”.   This Kuntres is from the archival treasures of the renowned Moreh Tzeddek, Rabbi Yissachar Ber HaLevi Horowitz of Lubavitch, a trusted member of the household and confidante of the Tzemach Tzeddek of Lubavitch. Rabbi Yissachar Ber owned many manuscripts by the Maharil of Yanovitz and the Tzemach Tzeddek of Lubaitch and more. Many of these manuscripts as well as many copies that he made of manuscripts he owned remained in his estate. (The entire volume from which this Kuntres was taken was previously sold at the Kedem auction house in 2017, auction 53, lot 60. According to their description in the catalog, the description written for the complete volume is only a ”partial description).  This review was written by the famed manuscripts scholar Rabbi Yosef Zvi Leader, who was among the circle of friends of the bibliographer Rabbi Yehoshua Mondshine and is an expert on Chabadic manuscripts.   The Chassidic scholar Rabbi Shimon Schwartz Shlita (who saw this entire Kuntres with all its appendices), wrote about this Bichel: ”Up to half of leaf 38a, it appears to be the script of the Tzemach Tzeddek, but I do not confirm it, as many imitated the Rebbes' handwriting. And until the end of page 38, it is the handwriting of the aforementioned Gaon Rabbi Yissachar Ber”.
