First Time Auctioned! Extremely Rare Polemic: Yekubal HaEmet by the Gaon Rabbi Yichye Abutbul of Safed - Livorno, 1879 - Single Edition - The only one in the world! Yekubal HaEmet - polemic pertaining to the last will on Minister Nissim Shamama of Paris - by Rabbi Yichye Abutbul of Safed - the Press of Reb Mordechai Finzzi - Livorno, 1879.  The last will of Minister Nissim Shamama was a controversial affair that stirred the rabbinic world in Tunisia and Eretz Yisrael. Several Kuntresim were published for and against the will's approval, such as Megaleh Amukot Mini Choshech, Yikubal HaEmet, and Mishpat HaYerusha. The affair began with the passing of Minister Nissim Shamama, who lived in Paris. After his passing, a will was found tied to his body, in which he bequeathed his assets to people who were not his heirs. This will sparked a great dispute among the rabbis. Some ruled to invalidate it because it was not made through the proper legal acquisitions (Darkei Kinyan) before his passing. Among those who ruled in favor of its validity were the author of Kapei Aharon and the Gaon Rabbi Avraham Ashkenazi. Among those who invalidated it were the author of Yashiv Moshe and the present author, Rabbi Yichye Abutbul, in this book, Yekubal HaEmet, as he writes on the title page: ”הורה גבר שהצוואה הנ”ל אין לה חלות לא מצד הדין ולא מצד דד”ד (דינא דמלכותא דינא) ולא מצד המנהג הבל היא ואין בה מועיל...”  [A man ruled that the aforementioned will has no validity, neither according to Jewish law, nor according to the law of the land, nor according to custom; it is a nullity and of no effect...].  Extremely rare! To the best of our knowledge, has never been auctioned!!! 12 leaves.  Old binding with tape to spine. Stains. Good condition.
