Letter that was not Published Handwritten and Signd by the Author of Chavatzelet Hasharon - pertaining to a Dispute about the Tradition of Five-Toed Chicken - Leysin, 1935 - I learned that they are not eaten in Krakow and Warsaw too - Responsum letter - about the controversy regarding the Kashruth of five-toed chicken - by the Gaon Chassid Rabbi David Menachem Manish Av Beit Din of Tarnopol - addressed to the Gaon Rabbi Eliyahu Botchko the Rosh Yeshiva of Monterey - Leysin, 1935.  Background: during the 1930s, a major halachic controversy arose in the cities of Europe regarding chickens characterized by a five-toed foot, instead of the four toes found in other chickens. Many Gedolei Yisrael forbade the consumption of these chickens due to the deviation from tradition, as the Rema famously ruled that one should only eat birds for which there is an established tradition of consumption. Regarding this dispute, several Kuntresim  were published - such as Derech Nesher and Kanfei Nesher, as well as responsa in many books by the leading Gedolei Hador.  This is a letter written by the Gaon of Tarnopol, who was a leading Meishiv, in response to Rabbi Botchko's question about Daat Gedolim on the subject. Rabbeinu the Chavatzelet Hasharon writes that he received the Kuntres allowing the consumption of such chickens ” and I have not found in it logical words to permit and in my opinion there is much to fear and one should stay away from them... and keep such chicken far away from his home, since I have learned that they are not eaten in Krakow and Warsaw too and some leading Hungarian rabbis have even forbidden the dishes used for them...” .  To the best of our knowledge, the content of this letter has never been published! Good condition.  ***  The Gaon Chassid Rabbi David Menachem Manish Av Beit Din of Tarnopol (1868-1937) a leading Meishiv, author of the famed Chavatzelet Hasharon Shut. Was a Belz Chassid. Was part of a delegation of Gedolei Hador alongside Maran the Chofetz Chaim, the Maharid of Belz and the Imrei Emes of Ger. Rabbi Aharon of Belz said of him that he was a Yehudi Kadosh from a century ago . Served as Rav of Strizov and Yabrov and then became Rav of Tarnopol, where he established a large yeshiva with many students. His many responses appear in the four sections of Shut Chavatzelet Hasharon.
