With the Original Version ”ואינה תשובה”! Fine copy in an Original Binding: Tzemach Tzeddek Piskei Dinim Two Sections - First Edition Vilna, 1884 - Sefer Tzemach Tzeddek, ”with Piskei Dinim from the Shulchan Aruch... by the Admor the Gaon... Rabbeinu Menachem Mendel, edited by his grandsons”. Vilna, 1884. Fine copy in an original binding with an embossed leather spine. Complete, especially fine copy! Section I: Orach Chaim and Yoreh Deah . The Press of Finn, Rosenkrantz and Shriptzetzer. [2], 286 leaves. The Chidushim contain Simanim and parts of Simanim from the Shulchan Aruch by Rabbi Yosef Karo with Rabbi Moshe Issereles' glosses, surrounded by the author's Chidushim.  Section II: Even HaEzer and Choshen Mishpat and elucidations and glosses by leading Rishonim and Acharonim including the Rambam, the Rosh, Rabbeinu Yerucham, Baal Haterumot, the Mordechai and the Maharshal and many Piskei Halachot of Masechet Yevamot and other tractates. The Press of the Rom Widow and Brothers. [2], 50; 70 leaves. The last four leaves contain omissions and corrections for both sections - these leaves are rare and are not in all known copies . As stated, an especially fine copy with two title pages for each section . Minor stains and a small tear not affecting the text to one of the title pages of Section II.  Very good overall condition. Rare copy with the original Chassidic version ”ואינה תשובה”. The ”forgery” polemic Printed on page 138 is the Admor the Tzemach Tzeddek's responsum beginning with the word ”Ituf”. Printed there in this copy: ”והגר”א הביא מנדרים... ואינה תשובה” [HaGra introduced from Nedarim...and this is no answer]. This copy is one of the single known copies with this version ; in most known copies, this responsum has a textual variation: ”והגר”א הביא מנדרים... ואנכי בעניי לא זכיתי להבין דבריו הקדושים” [HaGra introduced from Nedarim... and I the poor have not merited understanding his sacred words]. It should be noted that in some copies, the version ”ואינה תשובה” appears as in this copy, and this was the version that was later printed in the Kehot editions published by the Rebbe. Indeed, in recent years, this responsum was discovered in a manuscript by the Tzemach Tzeddek himself and there, the version is ”ואינה תשובה”.  ”And of course I could not dispose of all copies with the forged version” The Rebbe in his Igrot Kodesh addressed the matter, writing (section VIII, Igeret 2484): ”...I have heard from the Admor that the printers in Vilna (I haven't heard clearly whether the typesetter and his supervisor or the publisher too), which as you know at that time, the printing of the Piskei Dinim was the stronghold of the Misnagdim and apparently, added to it was that the year of 1884 was soon after the passing of the Admor Moharash and anyway, a time of emergency... so they seized the opportunity to forge and instead of ”ואינה תשובה”, printed the version copied by Kevod Torato, and when the first copies reached Lubavitch, they did all that was necessary and printed the last pages with the version of the Tzemach Tzeddek and of course I could not dispose of all copies with the forged version. There on page 122, there is a photocopy of a manuscript by the Tzemach Tzeddek with the original version of ”ואינה תשובה”; an article by the famed scholar Rabbi David Kamnetzky, Yeshurun, XX, p. 590 and onwards; and more. On the title pages, signatures and stamps of the Famed Chassidim of Safed, Rabbi Asher Yechezkel Halevi Horowitz and his son, Rabbi Yeshaya Halevi Horowitz.  *** The Chassid Rabbi Asher Yechezkel Halevi Horowitz (before 1860-1929), tenth generation from Rabbi Yeshaya Halevi Horowitz Baal HaShelah, fifth generation from the Admor Hazaken Baal Hatanya and a descendant of the Tzemach Tzeddek and the Admorim of Karlin, Chernobyl and Amdor. Rabbi Asher Yechezkel was the Memuneh of the Chalukah of Kollel Chabad of Safed and an important Chabad Chassid. He tried to open a Chabadic yeshiva in Safed, yet failed to do so due to financial difficulties.  The Gaon Chassid Rabbi Yeshaya Halevi Horowitz (1883-1978) the son of Rabbi Asher Yechezkel Halevi Horowitz and the son-in-law of Rabbi Yitzchak Loberbaum the grandson of the Rav of Safed, Rabbi Shmuel Heller. Since 1908, served as the Rav of the Chabadic community of Safed and Rav of the Tzemach Tzeddek Synagogue of the town.  Due to financial difficulties, in 1922, Rabbi Horowitz was forced to leave to Canada, where he served for over thirty years as the head of the rabbis of Winnipeg and the Chief Rabbi of Western Canada.  Authored important books including Yavo Shiloh, Pardes HaAretz and Eden Zion. In 1953, he returned to Israel. His son is the famed Chassid Rabbi Shmuel Horowirtz - an important Breslov Rav and Mashpi'a.
