This Buyer Disclaimer outlines the terms and conditions under which buyers (“you” or “the Buyer”) agree to use the Bidspirit platform for bidding on and purchasing items listed in auctions conducted by Shobrook Auctions Ltd.

By participating in any auction or purchasing items through Shobrook Auctions Ltd via the Bidspirit platform, you acknowledge and agree to abide by the following Terms and Conditions.

1. Bidding

By placing a bid on an item, you are committing to purchase that item if your bid is successful. You acknowledge that all winning bids are legally binding and cannot be withdrawn or retracted once placed.

You acknowledge and understand that, once the auction has ended, you may be required to purchase the item at the final hammer price together with the buyer’s premium, applicable taxes, shipping costs and any other associated fees.

2. Lot Descriptions & Condition

Whilst Shobrook Auctions Ltd aims to provide accurate and detailed information regarding all auction lots, descriptions, photographs and listing details are provided for guidance and informational purposes only and may not be exhaustive.

Buyers are encouraged to ask questions and request any additional information before placing a bid on any item.

Shobrook Auctions Ltd does not warranty or guarantee the accuracy, authenticity, provenance or condition of any item offered for sale. Any concerns regarding the condition or authenticity of an item should be addressed prior to bidding.

Shobrook Auctions Ltd strongly recommends that all prospective buyers attend the viewing and inspect any items they are considering purchasing in order to satisfy themselves as to condition, quality, completeness and suitability before bidding. All items are sold as seen.

3. Payment

By winning an auction, you agree to pay the full amount of your winning bid, including any applicable buyer’s premium, taxes, fees, delivery charges and shipping costs.

You agree to provide accurate payment details to Shobrook Auctions Ltd for the processing of all transactions and to complete payment promptly following the conclusion of the auction.

Failure to make payment within the required timeframe may result in:

• cancellation of the sale,

• the item being offered to another bidder or re-listed for auction,

• restrictions being placed on your bidding privileges,

• recovery of any losses or expenses incurred by the Auctioneers.

Shobrook Auctions Ltd accepts payment by:

• Cash

• Debit Card

• Chip & PIN

• Bank Transfer

Any applicable payment processing charges will be disclosed prior to completion of the transaction.

4. Collection of Goods

All lots must be paid for and removed from the auction house by 5pm on the Friday following the sale unless prior arrangements have been agreed.

Please contact the office before arranging collection of large or heavy items.

Purchasers are responsible for any damage caused during the removal of their items and must leave the premises in a safe and tidy condition.

5. Storage Charges

Any items paid for but not collected without prior arrangement will incur a storage charge from that date onwards of:

• £1 per lot per day, or

• £5 per larger item per day, plus VAT.

Storage charges will be added to the account and must be paid in full before goods can be collected.

6. Uncollected or Unpaid Items

Any paid items not collected before the next sale, without prior arrangement, may be re-entered into the following auction and sold on behalf of the purchaser without reserve.

Any unpaid items may also be re-entered into the next auction.

Restrictions may be applied to bidding privileges on accounts where payment or collection terms are not met. A record of non-payment may also be visible to other auction houses.

Any losses, storage charges, commissions or expenses incurred by the Auctioneers may be recovered from the purchaser.

7. Amendments to this Disclaimer

Shobrook Auctions Ltd reserves the right to modify, update or amend this Buyer Disclaimer at any time without prior notice. Any changes will be posted on the platform, and the effective date will be updated accordingly.

8. Governing Law

This Disclaimer shall be governed by and construed in accordance with the laws of the United Kingdom.

By using the Bidspirit platform and participating in any auction conducted by Shobrook Auctions Ltd, you agree to comply with all applicable laws and regulations.
