Herzl died in the city of Vienna on July 3, 1904, at the age of 44. He was buried in the Herzl family's grave estate in the Doubling Cemetery in Vienna. In his will he ordered that "I wish to be buried in a metal coffin, in the tomb estate next to my father, to lie there until the Jewish people transfer my body to the Land of Israel." 

On August 10, 1949, a bill was raised before the Knesset to raise Herzl's bones, and the law was passed by her on that day. The law stipulated that Herzl's will be established in Jerusalem on August 17, 1949.
