Terms and Conditions for Tyler Faulk Auctioneer, LLC

Conditions of Sale: 

When bidding on any lot offered by Tyler Faulk Auctioneer, LLC, the bidder indicates acceptance of the following Terms of the Sale. Any participation in the auction binds you to an agreement of these Terms. 

ALL SALES ARE FINAL .

Bidding: 

By bidding on an item, you are entering into a binding legal contract. 

Condition: 

Item condition and description: The property is sold in "as is, where is" condition and without recourse, and neither the Auction house nor the consignor makes any representation of warranties, express or implied, as to catalogue description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. It is the responsibility of the purchaser, prior to the auction, to examine the property and make determination as to the value, condition, description, authenticity, provenance, origin, size, and age of the property. We do not accept returns. We would be glad to take additional photos or to answer any questions about the items we offer for auction. 

All items sell as is where is without warranty. Not responsible for any accidents.

Payment: 

Tyler Faulk Auctioneer does not accept PayPal or Venmo. We accept Visa, Mastercard, and Discover credit cards. This auction uses Authorize.Net. If you place a winning bid, your card will be charged shortly after the conclusion of the auction or you will be notified to remit payment. 

1. This is an online auction only and you must register on one of the three bidding platforms: HiBid, BidSpirit, and AuctionZip/Invaluable platform. New registrations can be created by going to our website, faulkauctions.com and selecting the auction then hit register. 

2. You MUST register for a bidder number to bid online, including those who have permanent bidder numbers for our on-site auctions. Click on the "Register to Bid" tab and follow the directions. A valid credit card is required to obtain a bidder number. A $1.00 charge will be placed on your card for validation purposes only. This charge will be credited back to you. You will receive an email once your registration has been approved and you will then be able to place bids.

3. Please call Tyler @ 740-819-0362 with any questions you may have concerning the bidding process.

4. Online bid submissions are a legal binding contract, in which you agree to pay the amount you bid if you are the winning bidder. Under no circumstances will bids be edited/cancelled. DO NOT bid if you DO NOT intend to purchase.

5. Upon completion of the sale, you will receive an electronic invoice identifying lot(s) purchased and balance due.

6. The credit card you enter at the time of registration WILL BE AUTOMATICALLY CHARGED AT THE COMPLETION OF THE SALE.  We reserve the right to charge all non-paying bidders and they will be reported to various online platforms. CC fee is 2%. 

7. If bidding online, there is a 16% buyers premium. 

8.  If you are unable to attend pickup, please send someone else. If the scheduled pick up times DO NOT work for you, please contact us PRIOR to placing bids to ensure we can accommodate you. Any items that are paid for and not picked up will be shipped upon payment of shipping from buyer.

9. Purchases will be considered abandoned and become property of the auction company if shipping is not paid for within 7 days.

10. All items sold as-is, where-is, with no guarantees or warranties beyond what is implied. No refunds or returns.

Shipping:

SHIPPING available for this auction.  All items will be shipped through a third party called Shipping Saint. It is the BIDDER'S RESPONSIBILITY TO TAKE SHIPPING COSTS INTO CONSIDERATION WHEN BIDDING ON THESE ITEMS. Shipping methods include FedEx, UPS, USPS, or whatever method is best. Tyler Faulk Auctioneer cannot be responsible for loss or damage to the items during shipping. Items are insured through Shipping Saint. While we hope to get items shipped out as quickly as possible, timeframes can take up to 14 days depending on quanitity of items needing shipped, auctioneers other auctions, size of items, and more. By buying an item via the online platforms, you are agreeing that you are aware of shipping terms stated in the terms and conditions. Items will most likely be shipped out within three business days but this is not a guarantee. 

Large items such as furniture, large signs, etc. may be FOR PICK UP ONLY or private courier delivery as selected by the winning bidder or recommended local agent from Tyler Faulk Auctioneer. 

The buyer is free to contact any shipping company they wish, as the shipment is not limited to the agent provided by Tyler Faulk Auctioneer.
