An Extraordinary Letter from the Author of Even HaEzel to the Leading Jewish Jurist of Tel Aviv. Jerusalem, 1931 - A short yet fascinating letter by the illustrious gaon Rabbi Isser Zalman Meltzer, Rosh Yeshivah of Etz Chaim and one of the foremost Torah authorities of his generation, addressed to Dr. Philip Joseph, one of the leading jurists of Mandatory Palestine and brother of Dov Joseph, who would later serve as Israel’s Minister of Justice. Jerusalem, 1931. Before us is a rare meeting point between two towering figures from two very different worlds that helped shape the Jewish Yishuv in the years preceding the establishment of the State of Israel: on the one hand, a preeminent Torah scholar, the renowned author of Even HaEzel; on the other, a distinguished legal authority belonging to the highest ranks of the legal profession in the Land of Israel. The letter reads: “To Dr. P. Joseph, Tel Aviv. In reply to your letter, I have officially been released from the guardianship of the Rubin estate, and the sole remaining official guardian is Mr. Shimon Levin, administrator of the Old Age Home in Tel Aviv. Kindly direct your inquiries to him. Respectfully, Isser Zalman Meltzer.” In these few lines, a largely forgotten reality is revealed. In the Land of Israel of the 1930s, there was no rigid separation between the Torah world and the public and legal institutions of the country. Leading rabbinic authorities played active roles in the administration of communal institutions, trusts, and estates, maintaining ongoing contact with prominent lawyers and public figures of the developing Jewish community. Biography Rabbi Isser Zalman Meltzer (1870–1953) One of the foremost roshei yeshivah and halachic authorities of the twentieth century. He served as Rosh Yeshivah of Slabodka and later of Etz Chaim in Jerusalem. Author of the monumental Even HaEzel on Maimonides, he was regarded as one of the central figures of the Torah world during the first half of the twentieth century. Among his students were many of the leading rabbinic figures of subsequent generations, including Rabbi Aharon Kotler (his son-in-law), Rabbi Moshe Feinstein, Rabbi Elazar Menachem Shach, Rabbi Shlomo Zalman Auerbach and his son Rabbi Shmuel Auerbach, Rabbi Michel Yehuda Lefkowitz, several Chief Rabbis of Israel, and numerous other distinguished Torah scholars. It is related in the name of Rabbi Yitzchak Zev Soloveitchik of Brisk that his father, Rabbi Chaim Soloveitchik, considered Rabbi Isser Zalman the greatest among all the roshei yeshivah of Lithuania. He further recounted that in Volozhin exceptional students were ranked as “quarter prodigies” and “half prodigies, ” yet only one student was ever described as a “complete prodigy” — “Zunia from Mir, ” namely Rabbi Isser Zalman. Beyond his extraordinary scholarship, Rabbi Isser Zalman was revered as a saintly and exalted figure. Numerous stories illustrating his remarkable piety and devotion to spiritual refinement circulated among the elders of Jerusalem. Dr. Philip Joseph (1901–1968) One of the leading attorneys of Mandatory Palestine and among the most prominent legal figures of the Jewish Yishuv. His Tel Aviv law office was regarded as one of the foremost legal practices in the country, but his greatest fame stemmed from his role in some of the most dramatic political and security trials of the Mandate era. For many years he served as defense counsel for members of the Haganah and other underground organizations who were arrested by the British authorities and faced lengthy prison sentences or even capital punishment. He became particularly well known for saving Avraham Shein and Shalom Zhurbin from execution in the famous case tried alongside that of Shlomo Ben-Yosef. While Ben-Yosef was ultimately hanged, Joseph successfully argued that one defendant was a minor and that the other was not legally responsible due to his mental condition, thereby sparing both from the gallows. He also secured acquittals in several high-profile security cases, including the acquittal of the Altshuler brothers in the Ness Ziona affair, the defense of Jewish guards accused of possessing illegal arms depots, and representation of Haganah commanders in notable trials that captured the attention of the entire Yishuv. In the years before the establishment of the State of Israel, Philip Joseph was widely regarded as one of the most brilliant attorneys in the country and a figure who repeatedly stood at the forefront of the legal struggle to defend members of the Jewish community against British prosecution.
