Halachic Responsa Letter from Rabbi Yaakov Nunes Vais, Av Beis Din of Livorno – Citing Rulings of the Chida During His Lifetime!   Livorno, 1790 * A lengthy two-page halachic letter, handwritten and signed by the Gaon Rabbi Yaakov Nunes Vais, Av Beis Din of Livorno, one of the closest associates of the Chida and one of the leading Italian Torah scholars of his era. The letter contains four halachic teshuvos addressing practical and commonly encountered questions, including: if a person is called to the Torah while reciting Shemoneh Esrei, must he interrupt his prayer, or should someone else be called in his place; if one received an aliyah and mistakenly recited the concluding blessing, “Who has given us, ” instead of the opening blessing, “Who has chosen us, ” must he repeat the blessing; if one forgot Ya’aleh Veyavo during Mincha on Rosh Chodesh; and other matters. Throughout his teshuvos, Rabbi Yaakov references halachic rulings from the Chida’s sefarim on two occasions, underscoring the remarkable authority and influence the Chida’s decisions held even in his own lifetime. In the first teshuva, he writes: “Thus also ruled our master and teacher, the wonder of the generation, in his sefer Birkei Yosef.” In the third teshuva, he writes: “Thus also ruled my teacher and father, of blessed memory, in the sefer Beis Yitzchak, and this was likewise the conclusion reached by our aforementioned master and teacher in his illustrious sefer LeDovid Emes… and this is indeed the proper practical halachic ruling.” He concludes with a warm blessing: “Hineni — ‘here I am’ — an expression of affection, ever ready to be of service to you… particularly in matters of Torah, for ‘more than the calf wishes to nurse, the cow wishes to provide milk.’ I offer my prayer to the living G-d that your home be open wide; may this house be exalted; may your soul be enriched with blessing. Such is the heartfelt wish of your pure-hearted friend, who prays for your success…” He then signs with characteristic humility, using his well-known signature: “Tola’at (the lowly) Yaakov Nunes Vais, S.T.” To the best of Zaidy’s research in available databases, this letter has never been published. The Gaon Rabbi Yaakov Nunes Vais served as Rav of Livorno and was a rosh yeshiva there. He was the son of the Gaon Rabbi Yitzchak Nunes Vais and a nephew of Rabbi Yishmael HaKohen of Modena. He was a disciple of the Sha’ar HaMelech, Rabbi Yitzchak Nunes Belmonte. Renowned as a brilliant Torah scholar, he was also deeply engaged in Kabbalah. For further information, see Encyclopedia of the Sages of Italy, p. 216. Rabbi Yaakov was a devoted admirer of the Chida and, in turn, merited his exceptional esteem and affection. In one of his letters, the Chida refers to him as: “Our beloved and cherished one, the accomplished and all-encompassing scholar, a veritable Sinai, Rabbi Yaakov Nunes Vais… [he is] worthy of every honor” (Iggros VeHaskamos Rabbeinu Chida, Letter 17, pp. 28–29). In his manuscript works, Zera Yaakov and Afar Yaakov, Rabbi Yaakov frequently mentions the Chida with extraordinary reverence. The Chida, in turn, mentions Rabbi Yaakov in Shem HaGedolim, in the entry devoted to the sefer Siach Yitzchak by Rabbi Yitzchak Nunes Vais, which was published by his son Rabbi Yaakov. Rabbi Yaakov first published the fundamental work Daas Zekeinim by the Baalei HaTosfos (Livorno, 1783). He also published and edited several other sefarim, including HaMachria (Livorno, 1779) and Iggros HaRamaz (Livorno, 1780), which he proofread, adding his own notes to some of the works.
