Long Halachic Responsum Handwritten and Signed by Rabbi Moshe Provençal, of the Generation of the 'Beit Yosef' and One of the Greatest Poskin of Italy
A large leaf with a long halachic responsum handwritten and signed by Rabbi Moshe Provençal. Mantova (Mantua), 1562. The responsum contains his handwritten additions and erasures.
The content of the responsum: validation of a ruling of the Beit Din regarding a lawsuit filed by a Jewish physician and the question whether it can be discussed in another Beit Din. Rabbi Moshe Provençal discusses the importance of validating the original ruling of the Beit Din.
A large leaf written on both its sides. Signed by the young Moshe the son of Avraham Provençal.
The third page is empty. On the fourth page there are several handwritten lines.
Rabbi Moshe Provençal served as the rabbi of the Italiano community of Mantova, Italy and was known as a great Torah scholar and as an erudite person. He received questions by many people, from Italy and outside it.
It is most likely that in his youth he served as a Dayan in Modena and later as the rabbi of the Lo'azim community of Mantova, where he was head of a small yeshiva. He also gave lessons at the large synagogue of the town.
His reputation crossed the Italian borders and reached as far as Poland and the Land of Israel. His responsa is mentioned in the Rama Responsa (Siman 59), (Emunat Shnuel Responsa Siman 4), (Avkat Rochel Siman 195), the Mabit Responsa (2 138) and more, although many rabbis disagreed with him. In the many responsums he wrote he defended and supported the customs of the Italian Jews.
Rabbi Moshe Provençal aroused intense debates in Italy and outside it. These debates, which usually derived from his controversial halachic rulings, also often led to public attacks on him and several times he was even dismissed from his position as rabbi and banned. One of the greatest controversies he was involved in was when he disagreed with the Rama of Fano who ruled, according to the Kabbalah, not to lay Tefillin on Chol Ha'Moed. Rabbi Moshe decisively claimed that Tefillin must be laid On Chol Ha'Moed. The controversy continued to the next generations and many of the Italian contemporary rabbis defended the members of their communities who continued with their custom of laying Tefillin on Chol Ha'Moed, according to the halachic ruling of Rabbi Moshe.
Despite these controversies, Rabbi Moshe was eventually accepted as an important Posek. The Chida in his book "Shem Ha'Gdolim" states that although he abstained from introducing controversial rabbis in his book, he did not abstain from introducing Rabbi Moshe Provençal.
Rabbi Azarya min Ha'Adumim attests in his book Me'or Einayim, that Rabbi Yosef Karo allotted the task of publishing his Kesef Mishneh commentary on the Mishneh Torah of the Ramban to Rabbi Moshe Provençal. Indeed, in the first edition of the Kesef Mishneh which was printed during the years 1574-1576, the proofreader refers to him is his preface to the book.
Rabbi Moshe authored several books and some of his responsa were printed in the Maharam Provençal Responsa, two sections (Printed by the Jerusalem Institute). Among his books: Eleh Ha'Devarim, Mantova 1566. He also wrote an approbation for the Zohar, Mantova 1558 and glosses on the book Bechinat Olam, Mantova 1557.
Rabbi Moshe Provençal died on the 4th of Elul 1576. His leading disciple Rabbi Yehuda Muscato, who was known for his "Kol Yehuda" commentary on the Kuzari eulogized him.
